ACCEPTANCE OF TERMS AND CONDITIONS:
Payment of the initial reservation charge constitutes acceptance of the Termsand Conditions. We may, in our absolute discretion, cancel the reservationif we are of the opinion that the reservation information provided is falsifiedor incomplete.  You shall indemnify and hold us harmless in respect of anyliability, loss, damage, cost and expense of any nature arising out of, and/orin connection with the acceptance of the reservation.  The reservationterms and conditions set out herein shall be governed in accordance with thelaws of the State of California.  

PAYMENT: Payment for your reservation canbe made by Visa, Mastercard or American Express.  Allreservations require the reserving party to have a credit card on file. 50% due to reserve theproperty, balance due 30 days prior to check in date. Once we have received andapproved your reservation, we will automatically charge the provided creditcard based on the payment terms.  

CANCELLATION and/or RESERVATION CHANGES:If the cancellation is made 60days before the arrival date, full amount of the cost of the stay isrefundable. If the cancellation is made 30 days but less than 60 days beforethe arrival date, 50% of the TOTAL cost of the stay is refundable.Monies are non-refundable if cancellation is made less than 30 days beforearrival date.   

LONG TERM RENTAL POLICY:The Long-Term Rental Payment Policyapplies to all reservations of 28 nights or more.10% of the total cost is due toreserve the property (nonrefundable). Additional 40% of the total costof the stay is due at least 120 days prior to the check-in date (not refundableonce paid).Balance 50% of the total cost ofthe stay is due at least 90 days prior to the check-in date (not refundableonce paid). 

ONG TERM CANCELLATIONPOLICY: The Long Term Rental Cancellation Policy applies to all reservations of 28nights or more.The Reservation Deposit is not refundable - 10% of the total cost of thestay. If thecancellation is made more then 90 days prior to arrival date 50% of the totalcost of the stay is refundable. Monies are not refundable is the cancellationis made less then 90 days prior to arrival date.  

MINIMUM AGE 21: We do not allow personsunder our age policies to occupy a property unless accompanied by someone whois at least 21 years of age (or older).  

CONFIRMATION OF RESERVATION: If you elect to have us makethe reservation for you the system will automatically send you a confirmationemail containing a link to these terms and conditions. Payment of the bookingwill be the acceptance of the terms and conditions. 

CHECK-IN AND CHECK-OUT:  Check-in is after 4:00PM and Check-out isbefore 11:00 AM. Front door codes will not work until 4PM. Early check-in andlate check-out are not allowed unless prior agreed, late check-out fee may apply.The reserving party must be present for check in, the reserving party must providea valid government issued identification or passport that matches the creditcard payment. The entry code will be granted after verification is completed.

MAXIMUM OCCUPANCY POLICY:The Maximum occupancy requirements are based on theCity of Carlsbad’s ordinances.  Reserving party is responsiblefor the behavior of occupants and registered guests at all times. No visitingguest may sleep overnight in the Unit.  In no event shall any reservingparty have more than the maximum number occupants permitted (including children).Any violation of this policy shall result in our right to immediately terminatethe occupancy without refund.  All persons occupying a Unit must be listedby the reserving party on the reservation at time of reservation and shall be theonly persons entitled to occupy the unit or use any of the amenities duringoccupancy of the Unit.  Parties/Special Events/Weddings/etc. are not allowed in oraround the unit or in the common areas. If The Beach Palms Carlsbad discoversan event is or has taken place without prior approval, a fee up to $2000 willbe assessed. 

OCCUPANCY OF UNIT:  The person who made thereservation is responsible for the condition of the Unit, damages thereto ormissing items therefrom and for ensuring that all occupants and guests complywith the Terms and Conditions herein.  All occupants and guests ofoccupants must abide by all Federal, State and local laws and must conductthemselves in an appropriate first-class manner. Upon check out, the reservingparty is responsible for leaving the unit in good order before departure andfor ensuring that the Unit is, upon departure, in the condition that it was atthe commencement of the stay.  All furniture and accessories shall bereturned to their original location.

GARBAGE DISPOSAL, TOLIET ANDSINKS: Please do not put any item besides TOILET PAPER in the TOILET such as paper towels,baby wipes, flushable wipes, feminine products etc. – anything besidestoilet paper provided – may cause a plumbing issue. If this occurs, theguest will be responsible for the service call and repair. Likewise, please do notput peelings or any fibrous materials through the disposal. Run plenty of waterand feed material SLOWLY into the unit when using the disposal.SECURITYDEPOSIT/DAMAGE INSURANCE: Werequire the reserving party to purchase a damage insurance or pay a $500 damagedeposit. The damage deposit will be refunded within seven days after departurewhen the unit is inspected.  By booking this reservation, we reservethe right to charge the booking party’s for any missing items, or for anydamage, the reserving party or any occupant and/or guest of the reserving partymay have caused to the Unit. At the time of check-out, if the Unit is not leftin a reasonable and clean condition, or in the event of missing items, or ifany unpaid balance is still due, then the reserving party agrees andacknowledges that their credit card listed on file for the reservation will becharged to clean, replace, and/or repair said items at the fair market price ormake any unpaid payments pursuant to the terms of the reservationagreement. 

RATE CHANGES: Rates are subject to change without notice. Confirmed bookingrates will be honored for the reservation booked. Any additional nights will besubject to market rates which may be higher and are subject to availability.

PARKING: Each unit has one designated parking space. Please park only inthat space.

NON-SMOKING POLICY:  Smoking is prohibitedanywhere on the property, any smoke smell/odor in the Unit will result a$250.00 fee being charged to the credit card on file or deducted from damagedeposit.

PET POLICY: Pets are NOT allowed anywhere on the property. In the eventa service animal will be occupying a unit, the reserving guest shall provide acopy of the appropriate documentation evidencing the dog’s status as a bona fideservice animal.  If pet order or pet hairfound in the rental, additional $200 cleaning fee will be charged to the creditcard on file or deducted from the damage deposit.  FIRE PIT: The Fire Pit (in the courtyard) is a non-vented gas fired Fire Pit, please do not throw any paper orother combustible materials in the Fire Pit. Children should not be allowednear Fire Pit without adult-supervision, the Fire Pit pebbles and glasses arenot to be removed from the Fire Pit. Never leave the Fire Pit unattended. Children are not permitted to be in and around the Fire Pit area withoutadult supervision.  NOISE ORDINANCES: The city of Carlsbad has noiseordinances with which all occupants and guests must comply. Noise ordinances gointo effect at 10:00 pm and pertain to loud music, loud voices, or other loud soundscoming from a property after 10:00 pm. If we or the police are called due tothe occupants or any guests disturbing of the peace or violation of any noiseordinance we reserve the right to terminate occupancy and require immediatevacation of the Unit, in which case no money will be refunded to the reserving party.

POOL:  Hours 8 AM TO 9PM. The pool is to be used entirely atthe own risk of the Unit occupants and their registered guests.  Pool useis restricted to registered occupants and approved registered guests only.Children must be supervised by an adult at all times while in the pool area. NODIVING, BEACH OR SANDTOYS IN THE POOL. NO THROWING OF BALLS, TOYS or RUNNINGshall be permitted in the POOL/HOT TUB AREA.  NO GLASS SHALL BE PERMITTEDIN POOL/HOT TUB AREA.  

LOST AND FOUND: The Beach Palms Carlsbad is inno way responsible for personal belongings left behind in the property. A $25service fee and shipping costs will be billed to your credit card if yourequest us to package and return items you leave in the property.  ACCIDENTS, INJURY OR LOSS: The owners of the BeachPalms Carlsbad properties are not responsible for accidents, injury, death, orclaims or damages of any kind or loss of personal belongings of any kind toguest or any other person, or damage to any property occurring on the premises,any amenity property, or the common areas thereof.   The reservingparty, individually and on behalf of its occupants and guests, shall indemnify,defend, and hold harmless the owners of The Beach Palms Carlsbad and the realproperty owners from any and against all liabilities, injuries, claims,expenses, fees, loss of use, damages, or actions or claims of any kind arisingout of Renter’s or any of its occupants or guests’ use and occupancy of theUnit and amenities provided therewith, no matter how caused. The owners of TheBeach Palms Carlsbad properties shall not be responsible for acts of theft,vandalism or other damage to a guest(s) personal property or vehicle. 


FURNITURE AND ACCESSORIES: Furniture and accessory furnishings are notto be removed from the Unit. The folding beach chairs, boogie boards, beach umbrellas,sand toys, beach wagon are provided, and any other equipment, or items,provided by the owners of The Beach Palms Carlsbad, are to be used by theoccupants for their intended use only.  If any furniture or accessory locatedwith the Unit is lost, damaged or stolen, the reserving party will be chargedfor the replacement value of the missing item. Blankets and bath towels mustremain in the Unit. Beach towels are provided, and they may be used for thatpurpose. An inventory will be taken before and after each arrival and departure. In the event you experience any equipment failure, please notify us immediatelyso we can order repairs, as necessary. The Renter and its occupants and guestswaive and relinquish any rights or claims against the owners of the Beach PalmsCarlsbad for any damage that may result to the Renter or any occupant or guestfrom lack of maintenance, cleanliness, repairs or property defects. There willbe no refunds of all or any portion of the reservation amount for any equipmentfailure of any kind. In the event maintenance or repairs to a Unit arenecessary during the stay, it is understood and agreed that service techniciansmay require access to the Unit, with or without formal notice.  ACTS OF GOD: Occupant(s)acknowledgesthat their vacation stay may be scheduled during a time of inclement orundesirable weather, including, without limitation, rain storms, tropical storms,earth quicks  and the like (“Act of God”)In the event of an Act of God, or any inclement weather, including, withoutlimitation, adverse weather, tornadoes, earth quicks, storms, fire., etc., wewill not be responsible for any refunds for monies already paid, for preparingthe Unit for any upcoming anticipated or unanticipated Act of God, or forproviding lodging elsewhere. Occupant(s) acknowledges that, depending on thenature of the inclement weather or Act of God, evacuation may be required. Inthe event that any State, County or local government orders a voluntary or mandatoryevacuation of the Unit due to inclement weather or Act of God, Occupant(s)agrees to immediately evacuate the Unit. This is for the safety and protectionof our Occupants and Guests.  After check-in, any unused portion of the reservationdue to termination or early departure for any reason is non—refundable. In theevent of an Act of God, including, without limitation, adverse weather,tornadoes, earth quicks, storms, fire., etc., we will not be responsible forany refunds for monies already paid, for preparing the Unit for any upcominganticipated or unanticipated storm, hurricane or other Act of God, or forproviding lodging elsewhere.


GENERAL PROVISIONS: Failure to abide by these Terms and Conditions,or California Law, will, in our sole discretion result in the termination ofthe occupancy without refund. The laws of the State of California govern this agreement.We reserve the right of entry to the Unit at any time. While the informationprovided on our website is accurate to the best of our knowledge, it isunderstood that the information supplied is for guidance purposes only and doesnot form part of this Terms and Conditions Agreement. The prevailing party inany lawsuit to enforce or interpret any provisions of this agreement, orrelating to arising out of this Agreement, the guest reservation, guest stayand use of the Unit or any amenities provided with said Unit. This agreementcontains the entire agreement between the parties. It may only be changed inwriting signed by the party against whom enforcement of any waiver, change,modification, extension or discharge is sought. Renters cannot assign ortransfer this agreement. By reserving this unit and therefore agreeing to thisagreement you give The Beach Palms Carlsbad the permission to send you ongoingmarketing, promotional, and special discount type communications.  Theseare offered various times of the year and can be unsubscribed from if sodesired. By accepting this Rental Agreement as the guest, you agree to beresponsible for any damage(s) to the unit, dwelling, furnishings, grounds orcommon area which occur through acts of negligence of or by you, your family,friends or social guests. Guest agrees to surrender the Unit and personalproperty, furniture, and furnishings contained therein, at the time and datespecified in as good condition as it was at the beginning of your stay, exceptfor reasonable wear, act of God, and/or causes over which you have no control.If the unit is not left in satisfactory condition, you will be charged forrepair and restoration to satisfactory condition, plus lost rent time. Guestagrees to pay a reasonable attorney fee and all court costs and expenses toenforce this agreement including appellate proceeds with or without legalproceedings. Guest may not sublet the Unit at any time. Guest CERTIFIES thathe/she has read carefully and understands the limitations on a rental unit asset forth in this Lease Agreement. Guest ALSOCERTIFIES that he/she understandsthe limitations of the number of persons permitted to occupy a unit and the applicablefees. Guest fully agrees to abide by all such limitations and the foregoingTerms and Conditions.
